AVEFLIGHT determines the purposes and means of the processing described in this Policy and acts as controller. Some providers may act as processors for AVEFLIGHT or as independent controllers for their own purposes, for example a payment processor or a platform that manages its own user account.
Data-protection contact: requests may be sent to info@aveflight.com. If AVEFLIGHT appoints a Personal Data Protection Officer where legally required, the officer’s identity and contact details will be published on the Website.
This Policy applies to processing through https://aveflight.com, official storefront, checkout, and delivery interfaces used by AVEFLIGHT, and related communications. It is interpreted under Ecuador’s Organic Law on Personal Data Protection (LOPDP), its General Regulation, and other applicable law.
It does not govern the independent practices of third-party sites or services that do not act for AVEFLIGHT. When you use an external platform, you should also review that provider’s privacy policy.
AVEFLIGHT may maintain electronic databases or records concerning customers, orders, payments, invoices, delivery, licenses, access, support, security, and communications, hosted in its systems or those of Service Providers. Depending on your interaction, the following categories may be processed:
• identity and contact data: name, legal name, email, telephone, country, address, and communication preferences;
• billing data: identification, RUC, tax address, and information needed to issue receipts or invoices;
• order data: products, selected works, amount, currency, discounts, date, order number, and status;
• limited payment data: status, transaction identifier, method or brand, last digits where supplied by the processor, and fraud-prevention signals; AVEFLIGHT does not intend to receive or store full card numbers or security codes;
• delivery and license data: link sent, platform used, activation, access or download date and status, authorized Holder, issues, and replacements;
• support and communication data: questions, claims, files, receipts, responses, and background needed to resolve a request;
• technical and usage data: IP address, device, browser, operating system, language, pages viewed, dates, error logs, cookies, identifiers, security events, and approximate location derived from IP;
• marketing and consent data: newsletter sign-up or subscription, preferences, consent date and evidence, interactions, and withdrawal.
AVEFLIGHT does not ordinarily request sensitive data. Do not send health, biometric, genetic, confidential financial information, passwords, full identity documents, or other sensitive information unless AVEFLIGHT expressly requests it through an appropriate channel and has a lawful purpose and basis.
Data is obtained directly from you when you browse, purchase, complete forms, request an invoice, communicate, or use a link. It may also be received from the ecommerce platform, payment processors, video or cloud platforms, security providers, email operators, and legitimate public sources, always for a permitted purpose.
Where data is not obtained directly from you, AVEFLIGHT will provide the information required by law within the applicable period or at the time of the first communication, as appropriate.
AVEFLIGHT processes personal data only for determined, explicit, and legitimate purposes and under an applicable legal basis:
• pre-contractual steps and contract performance: manage the cart and Order, confirm payment, issue receipts, deliver Direct Downloads, activate Digital Licenses, provide the Production Dossier, verify the Holder, and provide support;
• legal obligations: accounting, tax, invoicing, responses to authorities, consumer protection, intellectual property, prevention of unlawful activity, and mandatory record retention;
• consent: promotional communications, non-essential cookies, optional features, or processing requiring authorization. Consent may be withdrawn without affecting earlier processing or processing based on another ground;
• legitimate interests, after an assessment where required: protect the Website, prevent fraud and abuse, defend claims, maintain security logs, improve operations, and produce limited statistics, provided the data subject’s rights do not override those interests;
• court order, vital interests, public source, or another basis expressly provided by law, only where applicable.
AVEFLIGHT will not use data for incompatible further purposes. If it proposes a materially different purpose, it will inform the data subject and obtain a new legal basis where required.
Operations may include collection, recording, organization, structuring, storage, consultation, use, comparison, verification, sending, disclosure, transfer, restriction, blocking, anonymization, erasure, and destruction by automated or non-automated means, as necessary for the stated purposes.
Complete payment-method data is collected directly by the processor enabled at checkout. AVEFLIGHT uses the limited information it receives to confirm transactions, reconcile payments, prevent fraud, manage refunds, and answer questions. The processor may perform authentication and authorization decisions under its own duties and policies.
To deliver a product and document that delivery, AVEFLIGHT and its providers may record that a link was sent, a download was generated, a license was activated, first access occurred, availability status, and technical events. This data is also used for support, security, license compliance, and refund-request review.
The Website and its Service Providers may use cookies, local storage, pixels, tags, logs, and similar technologies to operate the cart and checkout, maintain sessions, remember preferences, protect against fraud, measure performance, and, where authorized, perform analytics or marketing communications.
Strictly necessary technologies may be used to provide the requested service. Where consent is legally required for non-essential technologies, it will be requested before activation. You may manage choices through any consent tool made available on the Website and through browser settings; disabling necessary functions may prevent the cart, payment, or delivery from working.
Data is disclosed only where needed for a stated purpose and with appropriate contractual, technical, and organizational measures. Recipient categories may include:
• the ecommerce and storefront platform, including Ecwid;
• payment processors, banks, card networks, and fraud-prevention providers;
• hosting, security, analytics, email, communication, and support services;
• video and cloud-storage services used for delivery, which may include Sprout Video, pCloud, Google Drive, Ecwid, and Frame.io depending on the product;
• professional advisers, accountants, auditors, insurers, and legal providers subject to confidentiality duties;
• authorities, courts, or other recipients where a legal duty, order, or basis applies.
AVEFLIGHT does not sell personal data as a commercial activity or disclose it to third parties for incompatible independent purposes.
Some Service Providers may store or process data in Ecuador or other countries. Where a national or international transfer or disclosure occurs, AVEFLIGHT will seek to ensure that it is connected to a legitimate purpose, has the required legal basis and, where applicable, consent, and is supported by appropriate safeguards under the LOPDP and rules of the competent authority.
Safeguards may include processor agreements, data-protection clauses, confidentiality commitments, access controls, encryption, security measures, selection of adequate jurisdictions, or other legally recognized mechanisms. Recipients may belong to the categories listed above.
Fields identified as necessary allow AVEFLIGHT to process payment, identify the Order, issue a receipt, and deliver the product. If you do not provide them, AVEFLIGHT may be unable to accept or fulfill the Order. Optional data, including marketing data, is not required to purchase.
Incorrect or inaccurate data may cause payment rejection, incorrect billing, delivery to the wrong email address, inability to verify a license, or support delays. You should keep information current and may request correction.
AVEFLIGHT keeps data for as long as necessary for the purpose and then deletes, anonymizes, or blocks it unless retention is required by law or for the establishment, exercise, or defense of claims. Main criteria are:
• orders, payments, invoices, and accounting records: for the period required by tax, corporate, and accounting law and applicable limitation periods;
• license, delivery, and access data: for the license term or promised availability and afterwards for a reasonable support, security, and claims period;
• communications and claims: until the matter is resolved and for the period needed to document the response and address liability;
• marketing data: until consent is withdrawn, an objection is made, or the data is no longer needed;
• cookies and technical logs: for the period shown in any consent tool that is enabled or set by the provider, limited to what is needed for the relevant function, security, or analysis.
AVEFLIGHT applies reasonable technical, physical, administrative, organizational, and legal measures designed to protect confidentiality, integrity, availability, and resilience, including access limitation, authentication, backups, provider management, and monitoring where appropriate.
No system is completely secure. If an incident occurs, AVEFLIGHT will investigate, mitigate its effects, and make any communication or notification required by applicable law.
Under the LOPDP, subject to its conditions and exceptions, you may exercise rights of information, access, rectification and updating, erasure, objection, suspension or restriction, annulment where applicable, portability, and not to be subject to a decision based solely on automated assessments with legal or similarly significant effects. You may also withdraw consent and submit complaints.
Send a request to info@aveflight.com with the subject “Solicitud de Datos / Data Request”. State your name, the email used, any related Order, the right you wish to exercise, and information needed to identify the data. AVEFLIGHT may request proportionate identity or authority verification to prevent unauthorized disclosure.
Where portability applies, AVEFLIGHT will provide applicable data in a structured, commonly used, machine-readable format or transmit it to another controller where technically feasible and legally permitted. AVEFLIGHT will respond within the period required by law and explain any refusal or limitation.
If you believe the response is not satisfactory, you may complain to Ecuador’s Superintendence of Personal Data Protection (SPDP) through its official channels, without prejudice to other available remedies.
The Website and processors may use automated signals for security, fraud prevention, payment authorization, abuse detection, or technical operation. AVEFLIGHT does not intend, on its own, to make decisions based solely on automated processing that produce legal or similarly significant effects unless it provides notice, has a lawful basis, and offers the safeguards and human review required by law.
AVEFLIGHT will send promotional communications on the basis of consent or another valid ground. Each message will provide a reasonable unsubscribe mechanism. Objecting to marketing does not prevent necessary communications about an Order, payment, security, delivery, license, or relevant legal change.
The purchasing Service is not directed to minors who cannot contract on their own. AVEFLIGHT does not knowingly collect minors’ data for sales without the involvement or authorization of a legal representative where required. If unauthorized processing is identified, appropriate steps will be taken.
The Website may link to or integrate external services. AVEFLIGHT does not control independent processing by those third parties. Review their policies before creating an account or providing information directly.
AVEFLIGHT may update this Policy because of legal, technical, provider, or processing changes. The current version and date will be published on the Website. Where a change requires new consent or a specific notice, it will be provided before the relevant processing begins.
