These Terms and Conditions govern access to and use of the AVEFLIGHT website, purchases of digital content, direct downloads, Digital Licenses, Production Dossiers, and related electronic delivery services.

1. Scope and acceptance

These Terms apply to the website available at https://aveflight.com (the “Website”), including any official storefront, payment, account, confirmation, or delivery interface used by AVEFLIGHT S.A.S. and presented as part of the Service.

By visiting or using the Website, completing an order, selecting an acceptance box, making a payment, downloading a file, activating a Digital License, or accessing an audiovisual work, you confirm that you have read, understood, and accepted these Terms. If you act for a company or other entity, you represent that you have sufficient authority to bind it.

The Privacy Policy and Digital Delivery, Refund & Cancellation Policy form part of these Terms. Product-page terms, the order confirmation, a specific license, or a written AVEFLIGHT communication supplement these Terms and control only for the particular product or use they address, without limiting non-waivable legal rights.

3. Definitions

Digital Content: audiovisual works, videos, downloadable files, documentary materials, promotional materials, production-related files, and other content supplied electronically.

Direct Download: a digital file made available through the storefront or order confirmation, including automated delivery managed through Ecwid.

Digital License: a limited right of access and use that may be provided through a link, invitation, credential, code, access key, or authorization on a video or cloud-storage platform.

Holder: the person or entity identified in the order or expressly authorized by AVEFLIGHT to use a Digital License.

Production Dossier: a downloadable documentary archive associated with a work or set of works when included in the purchased product.

Order: a purchase request submitted through the Website and accepted by AVEFLIGHT after payment confirmation and, depending on the product, delivery confirmation or activation.

Service: the Website, storefront, payment processes, digital delivery, Direct Downloads, Digital Licenses, Production Dossiers, and related support.

Service Provider: a third party that assists in hosting, operating, securing, charging, communicating, transmitting, or delivering the Service.

You or User: the individual accessing the Service or the entity on whose behalf that individual acts.

4. Legal capacity

To make a purchase, you must have legal capacity to enter into a binding contract. If you are a minor or lack full legal capacity, the order must be made or authorized by your legal representative. AVEFLIGHT may request reasonable information to verify identity, authority, billing, fraud prevention, or legal compliance.

5. Catalogue, descriptions, and technical requirements

AVEFLIGHT aims to present titles, synopses, formats, duration, language, quality, delivery method, license scope, availability, and other characteristics clearly and accurately. Images, trailers, and samples are illustrative unless the product page states otherwise.

Before purchasing, you must review the description, permitted use, format, device, browser, connection, software, third-party account, territory, and access-period requirements shown for the product. Where an essential technical requirement is not clearly stated, you may request clarification from AVEFLIGHT before paying.

AVEFLIGHT may correct typographical, technical, availability, or pricing errors before accepting an Order. If a material error is found after payment but before delivery, AVEFLIGHT will offer you the choice of confirming the Order with the corrected information or receiving the corresponding refund.

5.1 Nature of the catalogue. The AVEFLIGHT catalogue brings together different genres and formats: (a) documentaries and training — courses and educational materials, including scientific and veterinary content in a professional, authorized context; (b) historical archive — classic film and archive material, restored or in the public domain; (c) themed scenic entertainment of suspense and horror, produced as theatrical fiction in escape room and haunted house settings (including the sets installed in the former Hospital La Carolina facilities, Quito, currently an escape room where the recordings take place). As is typical of this recreational format, such works may include sound and visual effects, props and horror-genre elements (for example, ghostly apparitions and effects), scenic scares, confinement or temporary-restraint mechanics as part of the scenic narrative, light sensory stimuli and tickling, always within a fictional, interpretive and controlled framework. By acquiring any product, the purchaser acknowledges the thematic nature and the recreational context of the content.

6. Prices, currency, taxes, and invoices

The total price, currency, and any applicable tax, surcharge, or cost are displayed before payment is completed. Prices may differ by product, work, set of works, license type, channel, territory, or promotion. A price change does not affect an Order already accepted.

The purchaser must provide accurate and complete billing information, including name or legal name, address, identification number, or RUC where applicable. AVEFLIGHT will issue any receipt or invoice required under applicable tax law.

7. Orders and acceptance

An automated receipt or payment message confirms that a request was received, but does not by itself constitute final acceptance where reasonable payment, fraud, availability, or license review remains pending. An Order is accepted when AVEFLIGHT confirms payment and enables or confirms delivery, unless the confirmation states otherwise.

AVEFLIGHT may reject or cancel an Order before acceptance where information is incomplete, an obvious error exists, delivery is impossible, fraud is reasonably suspected, access controls are being bypassed, rights are infringed, or these Terms are breached. If an amount was charged and there is no lawful basis to retain it, it will be refunded.

8. Payments and fraud prevention

Payments are processed through the methods and Service Providers available at checkout. Authorization depends on the card issuer, bank, network, or processor. AVEFLIGHT normally receives payment status, amount, currency, transaction identifiers, and limited payment-method details; it does not intend to store full card numbers or security codes.

You represent that you are authorized to use the payment method and that the information you provide is true, current, and complete. AVEFLIGHT and its providers may apply reasonable security, authentication, and fraud-prevention controls.

One-time payments. Purchases made through the Service are one-time payments and do not create recurring charges or automatic renewals.

Charge identification. AVEFLIGHT S.A.S. is the seller or licensor and the merchant responsible for processing purchases made through the Service. The transaction will appear on the bank or card statement under the descriptor assigned to AVEFLIGHT by the acquirer or processor, which may be displayed in an abbreviated form. The expected descriptor will be disclosed at checkout, in the Order confirmation, or on the payment receipt where available.

9. Digital-only delivery

AVEFLIGHT does not sell or ship physical products through this Service. Delivery takes place by Direct Download, email, confirmation page, customer area, access link, invitation, online viewing or playback, cloud transfer, or another electronic method described for the product or in the confirmation.

Details concerning timing, technical issues, cancellations, and refunds appear in the Digital Delivery, Refund & Cancellation Policy.

10. Digital Licenses and Production Dossier

In addition, the AVEFLIGHT catalogue includes a specific type of Digital License that functions as an access credential to an audiovisual work or set of works. Where stated on the product page, the license will also include the download of our documentary archive referred to as the Production Dossier. Its content, delivery method, and conditions of use will be those specified on the product page, in the Order confirmation, or in the specific license terms.

These Digital Licenses grant access to audiovisual works from the AVEFLIGHT SAS catalogue, hosted on secure video services and cloud storage platforms (such as Sprout Video, pCloud, Google Drive, Ecwid, or Frame.io). Access is granted to the holder upon payment confirmation and the amount of these licenses is variable and always corresponds to the value of the work or set of works purchased. When content selection is made through other specialized catalogs, sub-labels, or distribution channels, all of the same AVEFLIGHT establishment RUC 1793195454001, our system centralizes the payment by automatically generating the amount of these licenses to match the value of said selection, and enables delivery of the content once payment is confirmed. The commercialization, distribution, and payment collection for all digital content and products processed through this system correspond exclusively to the same ESTABLISHMENT, AVEFLIGHT S.A.S., RUC 1793195454001. No payments are processed or collected on behalf of other establishments. In the case of historical archive works, public-domain materials, or third-party licensed content, AVEFLIGHT acts as the holder of the legitimate rights of distribution and commercialization to the end user.

The access key, link, invitation, or credential is associated with the Holder identified in the Order. The Production Dossier is supplied as complementary documentary material and is subject to the same intellectual-property protection and use restrictions unless a different scope is expressly stated.

11. License scope

Purchasing Digital Content does not transfer ownership of the work or its copyright. Unless the product page, a specific license, an invoice, a quotation, or a written agreement grants broader rights, AVEFLIGHT grants the Holder a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to view or use the content only for private and internal purposes and within the stated period, territory, media, number of users, and other limits.

Commercial, public-screening, educational, festival, dissemination, broadcasting, production, promotional, institutional-archive, distribution, or other special uses must be expressly granted. Specific terms control the scope of the authorization.

Access to a third-party platform does not expand the license. The technical availability of a download, playback, or sharing feature does not authorize use beyond the rights purchased.

12. Use restrictions

Unless a written authorization or specific license states otherwise, you must not:

• copy, record, capture, reproduce, adapt, translate, modify, create derivative works from, publish, publicly display, or publicly perform Digital Content;

• sell, resell, rent, redistribute, sublicense, lend, share, or provide access to unauthorized persons;

• upload content or a Production Dossier to social networks, public repositories, file-sharing systems, marketplaces, databases, collective archives, or distribution channels;

• remove or alter credits, watermarks, metadata, copyright notices, rights controls, or security measures;

• circumvent payment, territory, duration, download, online viewing or playback, user, or device limits, or attempt to obtain unauthorized access;

• use content to train, populate, evaluate, or develop artificial-intelligence systems, machine-learning models, datasets, or competing products without written permission;

• use the Service or content unlawfully, deceptively, fraudulently, or in a way that infringes third-party rights.

13. Link and credential security

The Holder is responsible for keeping links, codes, credentials, and access methods confidential. You must promptly inform AVEFLIGHT of suspected loss, disclosure, unauthorized use, or security compromise. AVEFLIGHT may replace, limit, or suspend an access method where reasonably necessary to correct delivery, protect security, investigate fraud, or enforce the license, while preserving the purchaser’s mandatory rights.

14. Cancellations, returns, and refunds

Cancellations and refunds are governed by the Digital Delivery, Refund & Cancellation Policy and applicable law. Where Ecuadorian consumer law applies, any return or exchange right will be respected within the statutory period and to the extent the nature of the content or service allows it to be returned in the same condition.

Because a digital file can be reproduced and audiovisual access can be consumed immediately, an ordinary return may cease to be possible after download, first access, activation, or actual use. This does not limit rights relating to non-delivery, incorrect, defective, non-conforming, or inaccessible content attributable to AVEFLIGHT, or any other non-waivable rights.

Where mandatory foreign law provides a withdrawal period for digital content not supplied on a tangible medium, immediate delivery and any loss of the withdrawal right will take effect only if the information, prior express consent, acknowledgement, and confirmation required by that law have been provided. General acceptance of these Terms does not replace a separate consent where one is mandatory.

15. Intellectual property

The Website, audiovisual works, files, Production Dossiers, text, photographs, graphics, designs, trademarks, logos, promotional materials, metadata, and other elements of the Service belong to AVEFLIGHT, its licensors, or the relevant rights holders and are protected by intellectual-property law and applicable treaties.

Nothing grants rights beyond the license expressly purchased. Third-party names and marks belong to their respective owners.

16. Communications, requests, and submitted materials

Support communications, claims, receipts, and materials you send will be used to manage the Order, resolve the request, protect rights, and meet legal obligations in accordance with the Privacy Policy. You represent that you are entitled to submit any materials you provide and that they do not infringe third-party rights.

17. Permitted Website use

You must not interfere with the Website, introduce malicious code, conduct abusive scraping, test payment cards, automate fraudulent purchases, impersonate others, access restricted areas, overload systems, or attempt to defeat security measures. AVEFLIGHT may take proportionate action to prevent or stop such conduct.

18. Third-party platforms and services

The storefront, payment, and delivery processes may rely on Service Providers, including Ecwid and, depending on the product, Sprout Video, pCloud, Google Drive, Frame.io, or other secure platforms. Those providers may apply their own terms, privacy policies, account requirements, technical limitations, and security rules.

AVEFLIGHT does not control general outages, changes, or failures exclusively attributable to third parties and outside its reasonable control, but remains responsible for obligations that apply to it as seller or licensor under law and will seek a reasonable solution where a platform affects valid delivery.

19. Availability, maintenance, and technical changes

The Service may experience maintenance, updates, network errors, platform changes, or temporary interruptions. AVEFLIGHT does not promise continuous and uninterrupted operation, but will take reasonable steps to restore access or provide an alternative where appropriate. This does not remove the duty to deliver the product as described or any mandatory remedy.

20. Privacy and data protection

AVEFLIGHT processes personal data under its Privacy Policy and Ecuador’s Organic Law on Personal Data Protection. Information needed to process payment, prevent fraud, issue receipts, deliver content, verify a license, and provide support may be disclosed to relevant Service Providers.

21. Electronic communications and records

Orders, acceptances, confirmations, invoices, policies, notices, delivery links, and other communications may be supplied electronically. To the extent permitted by Ecuador’s Electronic Commerce, Electronic Signatures and Data Messages Law, electronic records and messages will have the effects recognized by applicable law.

22. Suspension or termination of access

AVEFLIGHT may suspend or terminate access where there is a material license breach, fraud, security risk, legal order, or unauthorized use. Where reasonably possible and no urgency exists, it will state the reason and allow the breach to be corrected. An unjustified suspension does not remove the purchaser’s rights or applicable remedies.

23. Warranties, liability, and mandatory rights

AVEFLIGHT undertakes to deliver the purchased Digital Content or access in accordance with the description and accepted conditions. Nothing excludes or limits liability for fraud, wilful misconduct, gross negligence, matters that cannot lawfully be limited, or consumer rights concerning information, quality, delivery, conformity, repair, return, or compensation.

To the extent permitted by law, AVEFLIGHT is not responsible for failures caused exclusively by incorrect User information, use contrary to disclosed requirements, the User’s device or connection, disclosure of credentials, unauthorized third-party acts, or events beyond its reasonable control. For Users acting for business purposes, AVEFLIGHT will not be liable for indirect or purely consequential losses that were not reasonably foreseeable when the contract was made, unless mandatory law provides otherwise.

24. Force majeure

Neither party is responsible for delay caused by extraordinary events beyond reasonable control, such as widespread infrastructure failure, disaster, conflict, government action, or mass provider outage. The affected party must mitigate the impact and resume performance as soon as reasonably possible. This section does not remove refunds or other remedies required by law where delivery becomes impossible.

25. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Ecuador. Before starting a dispute, the parties will try in good faith to resolve it by contacting info@aveflight.com.

Without prejudice to rights before consumer, data-protection, or other competent authorities, disputes will be heard by the competent courts of Quito, Metropolitan District, Ecuador, unless a non-waivable rule gives a consumer another venue or protection. Users in other countries retain any mandatory protections that apply to them and cannot be excluded by contract.

26. General provisions

If a provision is invalid or unenforceable, it will be interpreted or adjusted only as necessary and the remaining provisions will continue in effect. Failure to enforce a right is not a waiver. These Terms, incorporated policies, the product page, the Order confirmation, and any specific license constitute the agreement applicable to the transaction.

The Spanish version is the principal version for purposes of Ecuadorian law. The English version is provided for convenience; in the event of a discrepancy, the Spanish text prevails to the extent permitted by law.

27. Changes to these Terms

AVEFLIGHT may update these Terms to reflect legal, operational, technical, or commercial changes. The updated date will appear at the beginning. Changes apply prospectively and do not retroactively alter an Order already accepted unless the law requires it or the User expressly agrees.
